What does the application review entail for trademark registration in Ukraine?
The process is divided into two stages:
- Formal examination – The documents and the proof of fee payment are checked. The formally accepted application is published in the Bulletin (the official publication of the Intellectual Property Office of Ukraine) within 5 days.
- Substantive examination – NIPO analyzes the distinctiveness of the mark, any conflicts with previous marks, and the grounds for refusal provided for by law.
In the event of an opposition, our Ukrainian lawyers can analyze the grounds raised by the third party, prepare the legal arguments necessary to defend the trademark, and manage communication with the intellectual property authority.
How are the decision and certificate issued for registering a trademark in Ukraine?
If the trademark is accepted, the holder must pay the registration and publication fee within 3 months of receiving the decision. The trademark is then entered in the Register, and the rights are valid retroactively from the date of filing. The trademark certificate is valid for 10 years from the date of filing.
How to renew the trademark in Ukraine?
You can renew the trademark every 10 years, with no limit on the number of renewals. The procedure is simple:
- Normal period: the fee must be paid during the last 6 months of the protection period;
- Grace period: another 6 months after expiration, with a 50% increase in the fee;
- If the fee is not paid, the certificate expires, but the former holder has a priority right to re-register for 2 years.
If the trademark is not used for five consecutive years and is at risk of being cancelled at the request of a third party, our law firm in Ukraine can intervene by preparing the defense, presenting evidence of use, or justifying non-use for objective reasons. Our attorneys in Ukraine can also represent you before the authorities or courts, in order to prevent the total or partial cancellation of the trademark.
